Terms of Service

These Terms of Service ("Terms") govern your access to and use of Muse at Dawn (the "Service"), operated by ARTFUL COMPUTING INC ("we", "us", or "our"), a company located at 14725 Porter Rockwell Blvd Ste C, Bluffdale, UT 84065. By creating an account or using Muse at Dawn, you agree to be bound by these Terms.

1. License to use the Service

Subject to these Terms, ARTFUL COMPUTING INC grants you a limited, non-exclusive, non-transferable licence to access and use Muse at Dawn for your own personal or internal business use. Except where applicable law expressly allows it, you may not sell, copy, modify, interfere with, reverse engineer, exploit, or otherwise misuse the Service.

2. AI-generated content disclaimer

Anything Muse at Dawn produces is generated automatically by the AI models we operate, and does not represent the views of ARTFUL COMPUTING INC. Verify factual, medical, legal, or financial information independently before relying on it. We are not liable for decisions made on the basis of the output.

3. Eligibility and accounts

• You must be at least 18 years old, or the age of majority where you live, to create an account.
• You are responsible for keeping your login details confidential and for everything done under your account.
• Give accurate information when you register, and keep it current.

4. Disclaimers and limitation of liability

The Service is provided "as is" and "as available", without warranties of any kind. To the maximum extent permitted by law, ARTFUL COMPUTING INC will not be liable for indirect, incidental, or consequential damages arising from your use of the Service, and our total liability will not exceed what you paid us in the twelve months before the claim arose.

5. Service availability and changes

We may add, change, suspend, or discontinue any part of the Service at any time, with or without notice. The Service depends in part on the infrastructure that runs our models, our payment processor, and our hosting provider; their availability, performance, or policies can affect it. We are not liable for interruptions outside our reasonable control.

6. The Service

Muse at Dawn provides creative ideation features — idea seeds, fresh angles on a familiar subject, mood and word palettes, creative briefs, and candid critique of a draft — running on AI models that we deploy and operate ourselves on infrastructure under our control. Output is generated automatically — it may be inaccurate, incomplete, or unsuitable for your use case.

7. Changes to these Terms

We may update these Terms from time to time. Continuing to use the Service after a change takes effect means you accept the revised Terms.

8. Acceptable use

You agree not to use the Service to:

• Generate or distribute unlawful, defamatory, hateful, or sexually exploitative content, or any content involving minors.
• Produce political propaganda meant to manipulate opinion at scale, disinformation presented as fact, or content inciting violence or hatred.
• Work around Glimmer metering, rate limits, or safety controls.
• Reverse engineer, scrape, or resell access to the Service without our written permission.
• Build a competing product using our systems or outputs at scale.
• Use bots, scripts, or other unauthorised automation against the Service.
• Manipulate payments or Glimmers, or interfere with our infrastructure, other users, or normal operation.

9. Termination

We may suspend or terminate your account if you breach these Terms. You may stop using the Service at any time. Unused Glimmers are handled under our Refund Policy when an account ends.

11. Glimmers and payments

• Use of Muse at Dawn's AI features is metered in Glimmers. A new account holds none — there is no trial allowance — so Glimmers are obtained by buying a pack on the Pricing page before the first request.
• Glimmers are bought through the Pricing page. Payments are handled by a third-party payment processor. Available methods — Apple Pay, Google Pay and Cash App Pay — depend on your device, region, and browser.
• Charges appear on your statement as MUSEATDAWN. If you see a line you do not recognise, check for that name first.
• A Glimmer is consumed when a request completes, whether or not you are satisfied with the result — except where the Service fails to return anything because of a technical error, in which case nothing is charged.
• Glimmers have no cash value and cannot be transferred. Unless the law requires otherwise, they are non-refundable once used. See our Refund Policy for refund eligibility on unused purchases.

12. OFAC sanctions and geographic restrictions

We comply with trade sanctions, export control laws, and regulatory requirements enforced by the U.S. Department of the Treasury's Office of Foreign Assets Control (OFAC), as well as other applicable international and U.S. federal and state trade restriction laws. We do not offer, sell, ship, deliver, or facilitate transactions for individuals, entities, jurisdictions, or regions subject to comprehensive or targeted U.S. sanctions — including without limitation Cuba, Iran, North Korea, Sudan, Syria, and the restricted regions of Ukraine (Crimea, Donetsk, Luhansk) — or for any party on OFAC's Specially Designated Nationals (SDN) List, Blocked Persons List, or other applicable sanctions lists.

You represent and warrant that you are not located in, organised under the laws of, or a resident of any sanctioned jurisdiction, and that you are not listed on any U.S. or international government sanctions, watch, or restricted-party list.

We reserve the right to cancel, suspend, reject, or terminate any order, transaction, account, or access at any time, without prior notice or refund eligibility, if we reasonably determine that it involves sanctioned territories, restricted parties, or a breach of OFAC trade control regulations. We bear no liability for transactions rejected or terminated to meet sanctions compliance obligations.

13. Intellectual property

The Muse at Dawn name, logo, and site design belong to ARTFUL COMPUTING INC. Subject to these Terms, you may use output you generate for personal or commercial purposes, but it is your responsibility to make sure that use complies with the law and with any third-party rights.

14. Governing law and dispute resolution

These Terms are governed by the laws of the State of Utah, United States, without regard to its conflict-of-law principles. If a dispute arises, contact us first so we can try to resolve it informally. Any controversy or claim that cannot be resolved informally shall be settled by binding arbitration administered under the rules of a recognised arbitration association, seated in Utah unless otherwise agreed, and judgment on the award may be entered in any court having jurisdiction. You and ARTFUL COMPUTING INC each waive any right to bring a claim as a plaintiff or class member in a class, collective, or representative proceeding.
